While some members of the Duggar family initially released statements regarding the arrest, they continue to remain silent.

So how would law enforcement trace the illegal downloads to Duggar? An affidavit from Homeland Security Investigations Special Agent Gerald Faulkner explains that law enforcement searched a BitTorrent network to see downloads and tracked the IP address of those downloads to Duggar’s workplace , Wholesale Motorcars. After officers obtained a search warrant, they took Duggar’s phone, work computer and laptop.

As the trial date approaches, supporters of the Duggar family will likely hear a lot more from Josh Duggar. More recently, a Reddit the user released court documents from his defense team. Duggar’s defense is in support of a motion to suppress evidence. And one of the documents explains what happened when the police tried to download all the files.

According to documents, the government used the Torrential Downpour program. The program identifies child pornography content disseminated through file sharing networks. The document claims law enforcement spent “17 hours, attempting 169 times, to download only 13 of the 66 pieces which are only a small fraction of the ‘marissa.zip’ file that is said to have been stored on a computer shared located in a business six months before the government requested a search warrant.

Duggar’s defense team tried to combat this, however. They explained that if Duggar offered these files to strangers, Torrential Downpour would have downloaded the entire file “within minutes”. The defense alleged that the files were not “offered to strangers”. In addition, they said law enforcement needed a warrant to carry out the “extended follow-up.”

Defense team requested Franks hearing

With the news from Josh Duggar, what’s next for the defense? According to court documents, they want a Franks hearing. Franks hearing involves court determining whether “any of the police officers involved in the case lied to get a search warrant,” Hills At Law, PC, Explain.

Duggar’s defense team said the case now warrants a Franks hearing “and ultimately the removal” of the evidence. They believe federal agents made false statements. “A defendant is entitled to a Franks hearing if he ‘makes substantial preliminary evidence that a false statement was knowingly and intentionally, or with reckless disregard for the truth, included by the depositor in the affidavit of warrant” and ‘The allegedly false statements are necessary for the conclusion of probable cause,’ the court documents state.

We’ll have to wait and see what happens with Josh Duggar’s trial. The trial will begin in November 2021.
