A Texas district attorney has dismissed a sexual assault charge filed earlier this year by police in Austin against the son of former cyclist Lance Armstrong.

Luke Armstrong was charged in April for an incident in 2018. A woman told police in November 2020 that she was assaulted by Luke Armstrong after driving her to a party at her father’s house in Austin . Because she was 16 at the time and he was 18, Luke Armstrong was charged with child sexual assault. He had been free on a personal link.

According to Travis County Court files online, the case was registered as “DA Dismiss / No Charges Filed” on August 24. Travis County Attorney’s Office José Garza confirmed on Monday that the charge was dismissed and declined to comment further.

“Luke and his family are thrilled with the outcome and can’t wait to clear his name because of this baseless allegation,” said Armstrong attorney Randy Leavitt.

“We presented strong evidence to the district attorney’s office showing that the relationship between the two young people was completely consensual and therefore did not constitute a criminal offense,” Leavitt said. “Luke took two independent polygraph exams with the best examiners in the state, showing that he did not use any force or threat to obtain his consent.”

Lance Armstrong won the Tour de France seven times before being stripped of those titles following revelations he had used performance-enhancing drugs for much of his career.

According to the arrest affidavit released on April 1, the woman told police she met Luke Armstrong in June 2018 and was intoxicated at a party two days later when she called him to come get her. She told police she did not remember the ride but woke up in her house where she told police he sexually assaulted her and then drove her home.

She then made a taped call to Armstrong in December 2020, in which Armstrong admitted to having sex with her at her father’s house a few years earlier, according to the affidavit.

The girl told police she told six people that Armstrong had sex with her. Four of them remembered the girl describing the sex as non-consensual, according to the affidavit. One of them told police that she interpreted what had happened as consensual.

Leavitt previously said Luke Armstrong’s relationship with the girl continued after the incident in question.

Luke Armstrong was a reserve full-back for the Rice University football team in 2018-19. He retired from the 2020 season amid the coronavirus pandemic and has not returned this season.
